The IRS mandates that any loan between family members be made with a signed written agreement, a fixed repayment schedule, and a minimum interest rate.
Section 1288(b) provides that, in applying section 483 or section 1274 to a tax- exempt obligation (as defined in section 1275(a)(3)), under regulations prescribed by the Secretary, appropriate adjustments shall be made to the applicable Federal rate to take into account the tax exemption for interest on the obligation …

The Internal Revenue Service has released the Applicable Federal Rates (AFRs) for September 2021. AFRs are published monthly and represent the minimum interest rates that should be charged for family loans to avoid tax complications. The Section 7520 interest rate for September 2021 is 1.0 percent.
The § 7520 rate is used to discount the value of annuities, life estates, and remainders to present value, and is revised monthly. It is equal to 120% of the applicable federal mid-term rate under I.R.C. § 1274(d), but rounded to the nearest two-tenths of a percent.
3.25%
8, 2022, the current prime rate is 3.25% in the U.S., according to The Wall Street Journal’s Money Rates table, which lists the most common prime rates charged throughout the U.S. and in other countries by averaging out the prime rate from the 10 largest banks in each country.
Example of How to Use the Applicable Federal Rate (AFR)
If a party is issuing a loan to a family member, for instance, lets say a $50,000 for four years, the mid-term AFR rate will be applied. If the loan is for a period of three years or less, 2.72% or more will be charged as the interest rate.

For example, if a loan of $375,000 is refinanced by a mortgage of $300,000 at 6.5% interest rate, and a mortgage of $75,000 at 7.75% interest rate received for the same period, the blended rate will be calculated as ($300,000 * 6.5%) + ($75,000 * 7.75%) / $375,000 = 6.75%.
In the case of a demand loan, the applicable Federal rate shall be the Federal short-term rate in effect under section 1274(d) for the period for which the amount of forgone interest is being determined, compounded semiannually.

The Internal Revenue Service has released the Applicable Federal Rates (AFRs) for March 2020. AFRs are published monthly and represent the minimum interest rates that should be charged for family loans to avoid tax complications. The Section 7520 interest rate for March 2020 is 1.8 percent.
0.66% for “short-term” loans of three years or less. 1.29% for “mid-term” loans of more than three years but no more than nine years. 1.93% for “long-term” loans more than nine years.
The IRS will deem any forgone interest on an interest-free loan between family members as a gift for federal tax purposes, regardless of how the loans are structured or documented. Interest will be imputed if it is interest-free or at a rate below the AFR.
The imputed interest for the year on zero-coupon bonds is estimated as the accrued interest rather than
the minimum interest like in below-market loans.
It is calculated as the yield to maturity (YTM) multiplied by the present value of the bond.
Section 382 generally limits the use of NOLs and credits following an ownership change.
This occurs when one or more 5% shareholders increase their ownership, in aggregate,
by more than 50% over the lowest percentage of stock owned by these shareholders at any time during the testing period, generally three years.

The “mid-term rate” is determined from obligations with maturities of more than 3 years but not more than 9 years,
and the “long-term rate” is determined from obligations with maturities of more than 9 years.
Canada’s prime rate in 2021 is expected to remain stable for the year,
but there are increasing signals for an increase as soon as early 2022.
3.25%
By contrast, the lowest prime rate in history was set on March 16, 2020, at 3.25%.
The last time the U.S. economy experienced a 3.25% prime rate was in 1955.
The prime rate (prime) is the interest rate that commercial banks charge their most creditworthy customers,
generally large corporations. The prime interest rate, or prime lending rate,
is largely determined by the federal funds rate, which is the overnight rate that banks use to lend to one another.
Blended payments are a way of repaying a loan that sets equal monthly payments of principal
and interest (blended) over an agreed-upon amortization period.
By contrast, in a principal + interest arrangement,
the borrower pays back the same amount of principal each month, plus a steadily decreasing interest payment.
In most cases if you deposit more than $10,000 you will receive the 4% on the entire balance,
but in some cases you will only receive the 4% on the portion of the balanced. This is known as a blended APY.
Banks that offer blended APYs typically list the rate for the higher tier as a range.
The main tax implication of a loan to a family member is that the lender must pay tax on the interest they earn from the loan.
For instance, if you lend $100,000 at an interest rate of 4%, you would earn approximately $4,000 each year in interest income.
For a bad debt, you must show that at the time of the transaction you intended to make a loan and not a gift.
If you lend money to a relative or friend with the understanding the relative or friend may not repay it,
you must consider it as a gift and not as a loan, and you may not deduct it as a bad debt.
There are unlikely to be any immediate tax consequences if parents or other family members make you a loan.
But if you agree to pay them interest, the lender may have to pay tax on the interest they receive,
depending on their individual tax position.
Consider Whether to Charge Interest
How much that interest should be is up to you, but you’d probably want to charge no more than a bank.
Typically, lenders will charge anywhere from a friendly 3% to an obscene 36%.
If this is to a family member or friend, you should probably stay on the low side.
